Legal bases of data processing

In the context of our personalized complaint management survey, we process personal data on the basis of the following legal grounds:

Consent (Art. 6 para. 1 lit. a) GDPR) in connection with Art. 49 a) GDPR for third country transfers

for the fulfillment of contracts / business initiation (Art. 6 para. 1 lit. b) GDPR in conjunction with Art. 49 b) GDPR for third country transfers.

on the basis of a balancing of interests (Art. 6 para. 1 lit. f) GDPR).

We will refer to the relevant terminology in connection with the respective processing so that you can understand on what basis we process personal data.
If personal data is processed
on the basis of your consent, you have the right to revoke your consent at any time with effect for the future.
If we process
data on the basis of a balance of interests, you as the data subject have the right to object to the processing of personal data, taking into account the requirements of Art. 21 GDPR.

Processes

The basic storage of your data took place in the context of the purchase transaction and the creation of the customer account. If you have complaints about one of our products, we thereby comply with the fulfillment of contracts (purchase contract). 

Based on a consideration of interests and your consent for marketing communications (newsletter), we will send you a link to a survey to evaluate our complaints management in the follow-up to such complaints.  The storage of the personalized information is based on consent, for example, if you have clicked on the link to survey and have given consent there.

We transfer part of your personal data to the form in order to reassign your comments, additions or open unanswered questions to your complaint. This allows us to make targeted improvements based on your responses. For this purpose, we use a procedure that scales your answers. Furthermore, we analyze the answers and create reports for the management. If you have given a very negative rating during the process, Typeform will offer you to contact customer service again.

In the further course, the data in the central tool can be merged with other data sources that provide us with information on how the quality of our complaint management can have an impact on purchasing behavior.

This personalized service and the acquisition for market research purposes will only be carried out with your data if you have consented; legal basis: consent (Art. 6. para. 1. lit. a in conjunction with Art. 49 a GDPR) for third country transfers). Likewise, the consent applies to a possible data transfer to the USA. 

Purpose of processing

For the purpose of improving our complaint management and for the purpose of market research and product improvement, we use this procedure. 

Recipient of the data

To the extent that your data is stored in Typeform, your data will remain in Europe.  TYPEFORM SLC/Bac de Roda, 163 (Local), 08018 - Barcelona (Spain). There is an order processing contract with the company. 

When we prepare the data for further analysis, we use Y42. The provider of the service is Datos-Intelligence GmbH, Lohmühlenstr. 65, 12435 Berlin. There is an order processing contract with the company. 

Data processing outside the European Union

Your information from the survey will be processed outside the EU in exceptional cases.

We have to inform you about this separately. Typeform Barcelona belongs to TYPEFORM US LLC, 370 Brannan Street, San Francisco, CA 94107 (United States of America).  The so-called Standard Contractual Clauses (SCC) have therefore been concluded with Typeform in order to guarantee an appropriate level of protection. Typerform has also concluded these with the sub-service providers. 

The data storage Y42 takes place in the Google Cloud with data center Frankfurt. The operator is Google Inc. 600 Amphitheatre Parkway Mountain View CA USA, which is why a transfer to the USA cannot be excluded. Therefore, the so-called standard contractual clauses (SSC) were concluded to guarantee an appropriate level of data protection. 

According to the case law of the ECJ (judgment of 16.07.2020, ref.: C-311/18 ("Schrems II")), there is no adequate level of data protection in the USA. Furthermore, government surveillance measures may occur in the USA, where no adequate legal protection can be claimed against these measures. Data processing in the USA in connection with Typeform or Y42 is in this respect also based on your consent within the meaning of Art. 49 (1) a) GDPR. You can revoke your consent at any time with effect for the future.

Your rights as a data subject

You have the right to obtain information about the personal data concerning you. You can contact us for information at any time. 

In the case of a request for information that is not made in writing, we ask for your understanding that we may require proof from you that you are the person you claim to be. 

Furthermore, you have a right to rectification or deletion or to restriction of processing, insofar as you are entitled to this by law.

Finally, you have the right to object to processing within the scope of the law.

A right to data portability also exists within the framework of data protection law.

Data deletion

As a matter of principle, we delete personal data when there is no need for further storage. A requirement may exist, in particular, if the data is still needed to fulfill contractual services, to check and grant or defend against warranty and, if applicable, guarantee claims. In the case of statutory retention obligations, deletion will only be considered after expiry of the respective retention obligation. Delete

Your data will remain stored by us (for example in the market research database) until you object. Insofar as your data is stored by us in Typeform, your data will generally remain for 6 months.  As soon as we have completed the complaint process, we delete the data there.
